Terms of Service

1. Acceptance of Terms
CipherShift (“the Service”) is operated by Crackthump Pty Ltd, a company registered in Australia (“we”, “us”). By accessing or using the Service, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
CipherShift provides VPN service on your own private server. Each subscriber is provisioned an individual cloud server rather than being placed in a shared exit pool. The Service includes client applications and account management tools. We do not log your VPN traffic; the data we do handle is described in our Privacy Policy.
3. Account Registration
To use CipherShift, you must:
- Be at least 18 years old
- Provide accurate registration information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access
You are responsible for all activity under your account.
4. Acceptable Use
You agree NOT to use CipherShift for:
- Any illegal activity under applicable law
- Distribution of malware or malicious code
- Sending spam or unsolicited communications
- Harassment, threats or abuse of others
- Distribution of child sexual abuse material (CSAM)
- Attacks on network infrastructure (DDoS, hacking)
- Copyright infringement at commercial scale
- Fraud or identity theft
We reserve the right to terminate accounts engaged in prohibited activities without refund.
5. Payment and Billing
Subscription terms:
- Where you subscribe through the App Store or Google Play, payment, renewal, price-change notice and cancellation are handled by Apple or Google under their terms, and you manage or cancel the subscription in your store account
- Where you subscribe directly from us, payment is handled by our payment processor and you manage the subscription in your CipherShift account
- Subscriptions renew automatically until cancelled
- Prices may change. We give notice before a change takes effect, and store purchases follow Apple’s and Google’s price-change and consent rules
- No refunds for partial periods, except as required by law
6. 30-Day Money-Back Guarantee
New subscribers may request a full refund within 30 days of their initial purchase. This guarantee applies to first-time subscribers only and is limited to one refund per person. For direct purchases, request a refund at support@ciphershiftvpn.com. For purchases made through the App Store or Google Play, refunds are issued by Apple or Google through their own refund process, and we will help you with the request.
7. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible. We are not liable for service interruptions beyond our control, including cloud provider outages, network issues or force majeure events.
8. Intellectual Property
CipherShift, our logo and related marks are our trademarks. The Service, including software and documentation, is protected by copyright. You may not copy, modify, distribute or reverse engineer our software except as permitted by applicable law.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains what we collect, what we do not log, and confirms that we do not sell, share or disclose user data to third parties for any purpose.
10. Disclaimer of Warranties
EXCEPT FOR GUARANTEES THAT CANNOT LAWFULLY BE EXCLUDED, THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
If you are a consumer in Australia, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law, and nothing in these terms limits those rights.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRACKTHUMP PTY LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
12. Termination
You may cancel your subscription at any time, through your store account for store purchases or your CipherShift account for direct purchases. You may also delete your account outright in the app, from the home screen menu, then Delete Account. We may terminate or suspend your account for violation of these terms. On termination or deletion, your private server is decommissioned and your data is deleted as set out in the Privacy Policy.
13. Changes to Terms
We may update these terms from time to time. Material changes will be notified via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
14. Governing Law
These terms are governed by the laws of Australia, and you and Crackthump Pty Ltd submit to the jurisdiction of its courts. If you are a consumer, you may also have rights under the laws of the country in which you live.
